Terms and Conditions

These Terms and Conditions (“Terms”) govern use of lashher.com, Lash Her booking and checkout features, products, training services, communications, and the private Lash Her staff application. The website and application are operated by Lash Her by Nataliea (“Lash Her,” “we,” “us,” or “our”) in Ontario, Canada.

By using the public website or staff application, you agree to the provisions that apply to that use. These Terms form part of an order, booking, or training enrollment when they are presented or linked before the transaction and accepted by you, or when another legally valid method is used to incorporate them. If you do not agree, do not use the affected feature or complete the transaction.

Specific service, price, payment, cancellation, no-show, fulfillment, return, refund, or training terms displayed for an offering or expressly accepted at checkout form part of these Terms. If a transaction-specific term conflicts with these general Terms, the transaction-specific term controls for that transaction, except where prohibited by law.

These Terms do not limit rights or remedies that cannot lawfully be waived, including applicable consumer-protection rights.

Eligibility and accurate information

You must have the legal capacity to enter the applicable transaction. If you are under the age of majority where you live, a parent or legal guardian must complete or authorize the transaction where required.

You agree to provide accurate, current, and complete information and to update us if information needed to provide the service changes. You may not impersonate another person, use a payment method without authorization, connect an account you are not authorized to use, or interfere with security or access controls.

Website information and availability

We aim to keep descriptions, prices, images, availability, and other content accurate. Beauty-service results, colours, dimensions, packaging, training schedules, and other details may vary from examples or images. Obvious errors may be corrected before fulfillment. A submitted request or order is not accepted solely because the website received it.

The website, a particular time slot, product, program, promotion, or payment method may be changed, suspended, or unavailable. We do not promise uninterrupted or error-free access.

Service bookings

Availability and confirmation

Displayed appointment availability can change before checkout is completed. When you select a time, the application normally creates a temporary hold for the period shown during checkout. A hold is not a confirmed appointment.

Depending on the service configuration, checkout may offer full payment, a deposit, or a qualifying custom partial payment. Add-ons may be excluded from a promotion and may remain payable separately. Prices are in Canadian dollars, and service checkout applies Ontario HST to the amount paid at that time.

An appointment is confirmed only when Lash Her has accepted the booking and issued a confirmation. If payment succeeds but the selected time cannot be finalized, the booking may require manual review or rebooking. If Lash Her cannot provide the paid appointment after reasonable rebooking efforts, Lash Her will arrange an appropriate refund of the amount collected for that appointment, subject to applicable law and any separately agreed alternative.

Changes, cancellations, and missed appointments

The website does not currently provide self-service cancellation or rescheduling. Contact Lash Her promptly to request a change. A request is not effective until Lash Her confirms it.

Service checkout may display a policy authorizing Square to store the payment method and authorizing Lash Her to initiate a later charge for a missed appointment or late cancellation. The displayed maximum is a pre-HST amount unless checkout expressly states otherwise; applicable HST may be added to an authorized charge. Marking an appointment as a no-show does not by itself cause an automatic charge. Any later charge is reviewed and initiated by an authorized operator after the scheduled appointment has ended.

The current general Terms do not define a “late cancellation.” Lash Her will not rely on that phrase to impose a late-cancellation charge unless a specific notice period and the applicable charge were separately disclosed and accepted before the affected booking.

If the checkout offers a deposit or partial payment, the unpaid balance and any add-on balance remain due as described at checkout. The treatment of a payment after a timely cancellation or approved reschedule is governed by the transaction-specific policy presented for that appointment and applicable law.

Saved card authorization

For a service booking, checkout may ask you to authorize Square to save the card used for the appointment and permit Lash Her to initiate a later charge for a missed appointment or late cancellation under the policy you accept.

Square, rather than Lash Her, handles the full payment-card details. Lash Her retains provider references and masked card information needed to administer the authorization. A saved card may be used only for the purpose and amount permitted by the authorization accepted for that appointment, or under a new authorization.

Service information and results

Provide complete and accurate answers to service-intake questions and tell the service provider about known allergies, sensitivities, conditions, or prior reactions that may affect the service. Lash Her does not provide medical advice. Seek advice from a qualified health professional for medical concerns.

Individual results and retention vary based on natural features, sensitivities, aftercare, lifestyle, and other circumstances. Images and descriptions illustrate possible results and are not guarantees.

Product orders

Product prices are shown in Canadian dollars. The current product checkout revalidates price and availability before starting payment, limits quantities per line, and requires a delivery address. Product availability is not reserved merely because an item is in a cart.

Payment is processed through Helcim. A paid order is subject to final review for availability, payment validity, address completeness, and obvious pricing errors. Lash Her may contact you when fulfillment information or an address correction is needed.

The website does not promise a carrier, shipping territory, shipping speed, delivery date, tracking service, or pickup option unless one is expressly included in a retainable order confirmation or separately agreed in writing. A general fulfillment note on a product page is current informational content and is not a guaranteed transaction term unless it is preserved in that confirmation or agreement. Delivery estimates, where provided, are estimates unless expressly guaranteed.

Do not return a product without first contacting Lash Her for instructions. Return, exchange, damaged-item, incorrect-item, and refund eligibility are governed by the return or refund terms disclosed for the order and by applicable law. Nothing in these Terms removes a remedy available for goods that do not meet a non-waivable statutory condition or warranty.

Training programs

Training availability, format, prerequisites, included materials, scheduling, and price are described on the applicable program page or checkout. Training prices are in Canadian dollars, and the current checkout applies Ontario HST after eligible discounts.

Helcim is the standard training payment provider. Where offered, an alternative invoice or buy-now-pay-later option may be processed through Square and is subject to provider approval and availability. Displaying a payment option does not guarantee that the provider will approve it.

After confirmed payment, Lash Her may provide a time-limited link to schedule an initial call or next step. The current scheduling link is generally valid for 14 days. Complete the scheduling step before the stated expiry and contact Lash Her if the link fails.

Training checkout currently describes training payments as non-refundable. This does not apply where a refund is required by law or Lash Her has expressly agreed otherwise in writing. Any rules concerning transfers, rescheduling, non-attendance, provider cancellation, access periods, certification, or included materials must be stated for the specific program to apply.

Training content is educational. Completion does not guarantee certification by a third party, licensing, employment, clients, income, business performance, or a particular result unless a written program description expressly makes that commitment.

Prices, taxes, promotions, and payment

Unless stated otherwise:

• prices are in Canadian dollars;
• applicable taxes are shown or described for the relevant checkout;
• a promotion applies only to eligible items or services;
• one promotion-code field is available per checkout, although an eligible code may combine with a manually displayed sale price;
• a discount cannot reduce the eligible amount below zero; and
• a cart, quote, invoice, or pending payment does not guarantee continued availability.

We may refuse an invalid, ineligible, altered, or fraudulently used code and correct an obvious pricing or calculation error before accepting a transaction. If a correction materially changes an amount after payment, we will contact you and provide the remedy required by law.

Payments may be refused, held, or reversed by a payment provider. You remain responsible for accurate billing and contact information and for charges you validly authorize.

Staff accounts and Google services

The staff application is for employees, contractors, and other users expressly approved by Lash Her. A Google Account alone does not create a staff account. Staff access remains subject to assigned roles, employment or contractor obligations, and any separate confidentiality or acceptable-use requirements.

An authorized user may connect only a Google Account and calendars that the user is entitled to access. The permissions requested through Google are used only as described on the Lash Her Google Integration page and in the Privacy Policy.

The user may withdraw Google authorization through available Lash Her account controls or Google Account settings. Withdrawing authorization may disable Google Sign-In or Calendar-dependent features. Disconnecting does not automatically delete events already created in Google Calendar or records Lash Her must retain.

Google services are provided by Google and are also subject to Google’s applicable terms and policies. Nothing in these Terms grants Lash Her a right to use Google user data beyond the uses described in the Privacy Policy and permitted by Google’s API policies.

Staff must keep credentials and devices secure, sign out of shared devices, promptly report suspected compromise, and must not share a staff session or attempt to access information outside their assigned role.

Communications

By providing contact information for an inquiry or transaction, you authorize service-related communications needed to respond, administer the transaction, address security or payment issues, and meet legal obligations.

Marketing messages require the consent or other permission required by applicable law. You may unsubscribe through the control in a marketing message or by contacting us. Unsubscribing from marketing does not prevent transactional messages about a booking, order, payment, training enrollment, security issue, or requested service.

Content and intellectual property

The website, staff application, branding, layout, original photographs, text, graphics, videos, training materials, and software are owned by Lash Her or used with permission and are protected by applicable intellectual-property laws.

You may view and use public website content for personal, non-commercial purposes connected with evaluating or receiving Lash Her offerings. You may not reproduce, sell, publish, distribute, scrape, reverse engineer, remove rights notices from, or create derivative commercial materials from protected content without permission, except where applicable law permits.

You retain rights in material you submit. You give Lash Her a limited permission to use, copy, transmit, and disclose that material only as reasonably needed to respond to you, provide the requested service, maintain records, secure the application, and exercise rights described in the Privacy Policy. This permission does not grant Lash Her a right to use customer material in advertising or a public portfolio without any additional consent required for that use.

Prohibited use

You may not:

• use the website or application unlawfully, deceptively, or fraudulently;
• interfere with operation, probe for vulnerabilities, bypass access controls, or introduce malicious code;
• use automated collection in a manner that burdens the service or infringes rights;
• access another person’s account, booking, payment, Calendar, or personal information without authorization;
• submit unlawful, harmful, infringing, or misleading content; or
• use Lash Her branding or content to imply an endorsement or affiliation that does not exist.

We may restrict access, cancel a request, or preserve relevant evidence where reasonably necessary to address suspected fraud, abuse, security risk, or a material violation, subject to applicable law and any required refund.

Third-party services and links

The website and application rely on or link to services provided by Google, Square, Helcim, Vercel, Resend, Sanity, and other infrastructure or communications providers. A third party’s own terms and privacy notice apply when it independently provides a service to you. Lash Her is not responsible for an unrelated third-party website merely because it is linked, but this does not limit responsibility Lash Her has for service providers acting on its instructions.

Disclaimers and limitation of responsibility

To the extent permitted by law, the website and staff application are provided on an “as available” basis. We do not guarantee uninterrupted access, that every error will be corrected immediately, or that a particular product, appointment, program, payment method, or third-party service will remain available.

Lash Her is responsible for direct loss caused by its breach of these Terms or negligence to the extent required by applicable law. To the extent permitted by law, Lash Her is not responsible for indirect, incidental, or consequential loss that was not reasonably foreseeable when the transaction was made, or for delay or failure caused by events outside its reasonable control.

Nothing in these Terms excludes liability for fraud, intentional misconduct, gross negligence, personal injury caused by negligence, breach of a non-waivable consumer guarantee, or any other liability that cannot lawfully be excluded or limited.

Suspension and termination

You may stop using the public website at any time. Authorized staff may sign out and may request disconnection of an eligible Calendar connection, subject to reassignment of any active booking destination.

Lash Her may suspend or terminate staff access when authorization ends, an account is compromised, or use materially violates these Terms or applicable staff obligations. Provisions concerning accrued payment obligations, intellectual property, privacy, records, disclaimers, disputes, and other terms that by their nature should continue will survive termination.

Governing law

These Terms are governed by the laws of Ontario and the federal laws of Canada applicable there, without excluding mandatory consumer protections that apply where you live. Courts with lawful jurisdiction in Ontario may hear disputes, but nothing in this section prevents a consumer from using a court, tribunal, regulator, or remedy available under non-waivable law.

Changes to these Terms

We may update these Terms to reflect service, business, or legal changes. The revised Terms will be posted at this URL with a new effective date. Where these Terms are incorporated into a transaction, the version presented or made available before acceptance governs that transaction unless a change is required by law or separately agreed.
